Two Distinct Cases

Following an arrest for DWI or DUI, the defendant will face two distinct legal proceedings:

DMV Administrative Hearing

The first case involves the DMV Administrative Hearing, which must be requested by the defendant’s attorney. During this hearing, the defense attorney will contest the proposed suspension of the driver’s license, either for refusing the breathalyzer test or for having a blood alcohol concentration above the legal limit. It’s crucial for the defendant to understand that the arrest paperwork won’t provide a court date for this hearing. Moreover, the attorney has only 30 days from the date of arrest to request this hearing; failing to do so results in a waiver of the right to a hearing.

DWI Prosecution in Criminal Court

The second case takes place in criminal court, where a judge and prosecutor oversee proceedings. As DWI is considered a criminal offense, it is tried alongside other criminal cases. The court date mentioned in the summons or arrest paperwork pertains to the criminal case.
