  • -Jail Time: The sentence may include 10 days to 6 months in jail.

  • -Driver’s License Suspension: A 12-month driver’s license suspension is mandatory, increasing to 2 years if the BAC is 0.20% or higher.

Additionally, first-time offenders could potentially face 48 hours to six months in jail. Other potential penalties for DWI include:

  • -Probation: Offenders may receive probation, during which they may or may not be allowed to drive.

  • -Mandatory Programs: The court may require participation in three mandatory 30-hour re-education programs, which include a driver improvement program, substance abuse program, and a MADD victim program.

  • -Community Service: Offenders may be assigned community service, typically involving tasks like street cleaning.

Special Penalties

  • -High BAC: If the BAC is over 0.15%, an additional 48 hours of jail time is mandatory, which cannot be suspended.

  • -Very High BAC: With a BAC exceeding 0.20%, offenders face 48 hours in jail, a fine ranging from $750 to over $1,000, and the installation of an ignition interlock system in their vehicle for two years.

  • -Child Endangerment: Violating child endangerment laws may result in non-suspendable jail sentences, among other penalties.
