Penalties for Obscenity in Louisiana

Obscenity is a felony in Louisiana. Most obscenity charges are not considered a “Sex Offense” in Louisiana, which would require registration as a sex offender. But if you are convicted, the judge may sentence you to prison time. The judge can suspend some or all of that time and place you on felony probation with the State of Louisiana. On a first conviction, whoever commits the crime of obscenity shall be fined not less than $1000 nor more than $2500, or imprisoned, with or without hard labor, for not less than 6 months nor more than 3 years, or both. If you are placed on probation, the judge may order special conditions of your probation such as community service, rehabilitative classes, treatment, ankle monitor, probation fees, and pay fine and court costs.

Obscenity by Solicitation of a Person Under the Age of Seventeen – R.S. 14:106(A)(5)

An obscenity charge gets much more serious if the obscenity charge is alleged to have been committed while in the presence of a minor.  When a violation of obscenity is with or in the presence of an unmarried person under the age of seventeen years, the offender shall be fined not more than $10,000 and shall be imprisoned, with or without hard labor, for not less than 2 years nor more than 5 years, without benefit of parole, probation, or suspension of sentence.

The only obscenity conviction that requires the defendant to register as a sex offender in Louisiana is if a minor is present. Obscenity then becomes a sex offense.

La. R.S. 15:541(24)(a) states that a “Sex offense” means deferred adjudication, adjudication withheld, or conviction for the perpetration or attempted perpetration of or conspiracy to commit human trafficking when prosecuted under the provisions of…..R.S. 14:106(A)(5) (obscenity by solicitation of a person under the age of seventeen).
